Terms of Use for the COOMS Website

1. Purpose and Acceptance

These Terms of Use govern access to and use of the COOMS website. By accessing the Site, you acknowledge that you have read and agree to these terms.

If you do not agree to these Terms of Use, you must not use the Site.

COOMS may amend these Terms of Use at any time. The version posted on the Site at the time of the relevant use shall apply.

2. Definitions

In these Terms of Use, the following terms have the meanings set forth below:

COOMS Terms and Conditions: the terms and conditions applicable to purchases made on the Website.

Contest: any game, contest, or promotional campaign organized by COOMS and published on the Website.

Terms and Conditions for Participation in COOMS Contests or Terms of Participation: the rules governing the Contests.

Content: all text, images, photographs, videos, logos, graphics, trademarks, technical elements, and information (including recipes) published on the Site.

Privacy Policy: COOMS' privacy policy regarding the processing of personal data.

Products: cookies and, more broadly, the products offered for sale on the Website or in-store.

Website: the website operated under the COOMS brand, as well as any smartphone apps.

User: any person who accesses or uses the Site.

The contractual documents referred to in Section 3 may assign specific meanings to certain terms that begin with a capital letter. These terms have the same meaning in these Terms of Use, unless otherwise specified.

3. Overview of other contractual documents

The Site uses several supplementary documents:

the COOMS Terms and Conditions, which govern the purchase of Products;
the Terms and Conditions, which govern participation in the Contests;
the Privacy Policy, which governs the processing of personal data.

With regard to the sale of Products, the COOMS Terms and Conditions of Sale apply. With regard to data protection, the Privacy Policy applies.

In the event of any conflict between these Terms of Use and the COOMS Terms and Conditions, the latter shall prevail.

15. Governing Law and Jurisdiction

These Terms of Use are governed by Swiss law, excluding the rules of private international law.

Subject to any mandatory jurisdiction provided for by law, the competent courts are those of the Canton of Geneva.
